These Terms of Use govern your use of the Nuza website at nuza.co.ke and the Nuza mobile app (together, "Nuza"). Nuza is operated by [Legal entity name], [Registration number], [Physical address], Kenya ("we", "us"). By creating an account or using Nuza, you agree to these Terms. If you do not agree, do not use Nuza.

1. What Nuza is

Nuza is an online classifieds platform where people and businesses post adverts to buy, sell, rent or offer goods, property, jobs and services. We are not a party to any transaction between users. We do not own, inspect, store or deliver the items advertised, and we do not guarantee the quality, safety, legality or accuracy of any advert or user.

2. Eligibility and accounts

• You must be at least 18 years old to create an account or post adverts.
• You must give accurate information and keep it up to date.
• You are responsible for everything done through your account. Keep your password and verification codes private.
• One person or business may not operate multiple accounts to get around limits, bans or reviews.

3. Posting adverts

When you post an advert, you confirm that:

• you own the item or have the right to sell, rent or offer it;
• the description, price, photos and location are accurate and not misleading;
• the photos are your own or you have permission to use them;
• the advert is placed in the correct category and complies with Kenyan law.

We may review adverts before or after they go live, and we may edit the category of, reject, or remove any advert at our discretion, without refund where the advert breaks these Terms.

4. Prohibited items and content

You may not advertise or post:

• stolen goods, or goods without valid ownership documents (for example vehicles without a logbook);
• counterfeit or pirated goods;
• weapons, ammunition, explosives, or their parts, except where you hold the required licence and the law allows the sale;
• narcotic drugs, psychotropic substances, or prescription-only medicines;
• wildlife, game meat, ivory, rhino horn or other protected species and their products;
• forged documents, ID cards, certificates, number plates or SIM cards registered to others;
• adult or sexual content, or services of a sexual nature;
• pyramid schemes, "get rich quick" offers, unlicensed lending, betting or investment schemes;
• job adverts that ask applicants to pay a fee to be hired;
• content that is hateful, discriminatory, threatening, defamatory, or that infringes someone else's rights;
• personal information of other people without their consent.

5. Your conduct

You agree not to:

• scam, defraud, mislead or harass other users;
• post duplicate or spam adverts, or bulk-message users;
• use bots, scrapers or automated tools to access or copy Nuza;
• interfere with Nuza's security or operation, or try to access accounts that are not yours;
• move conversations off Nuza for the purpose of defrauding another user.

6. Dealing with other users

All transactions are solely between buyers and sellers. Protect yourself:

• Meet in a safe, public place and inspect items before paying.
• For vehicles and property, verify ownership documents and searches with the relevant authority before paying.
• Never send a deposit or advance payment (including via M-Pesa) to someone you have not met for an item you have not seen.
• Report suspicious adverts or users using the Report button.

7. Paid features

Some features, such as featured adverts and listing packages, are paid. Prices are shown in Kenya Shillings before you pay. Payments are processed by third-party payment providers and are subject to our Refund Policy.

8. Content licence

You keep ownership of the content you post. You grant us a non-exclusive, royalty-free licence to host, display, reproduce, resize and promote your adverts on Nuza, our social media channels and partner sites, for as long as the advert is live and for a reasonable period after for backups and records.

9. Suspension and termination

We may suspend or close your account, and remove your adverts, if you break these Terms, if we suspect fraud, or if required by law. You may delete your account at any time from your profile settings.

10. Disclaimers and limitation of liability

Nuza is provided "as is" and "as available". To the extent permitted by Kenyan law, we are not liable for any loss arising from transactions between users, from adverts or content posted by users, or from interruptions to the service. Where liability cannot be excluded, our total liability to you is limited to the amount you paid us in the 12 months before the claim. Nothing in these Terms limits your rights under the Consumer Protection Act, 2012.

11. Reporting and cooperation with authorities

We may share information with the police or other authorities where required by law or to investigate fraud or other unlawful activity on Nuza.

12. Changes to these Terms

We may update these Terms from time to time. We will post the updated version on this page with a new effective date, and notify you of significant changes. Continuing to use Nuza after that means you accept the updated Terms.

13. Governing law

These Terms are governed by the laws of Kenya. Any dispute will be handled by the courts of Kenya.
